The National Securities Market Commission (CNMV) has fined Vidrala, Basque company for the manufacture and sale of glass containers, with 150,000 Euros and its financial director, Raúl Gómez Merino, with another 30,000 Euros for carrying out handling practices in the market in the period between September 1 and October 19, 2015. In addition, the stock market regulator has imposed a sanction of 40,000 Euros on Norbolsa, a financial services entity, for failing to comply with its obligation to notify this organization of suspicious transactions of irregularities made by the company based in the province of Álava.
These penalties have been published this Friday in the Official State Gazette (BOE).
The CNMV considers that Vidrala, its financial director and Norbolsa committed a serious infraction typified in the Securities Market Law. The fines imposed by the regulator have been declared final in administrative proceedings but there is still the possibility of appealing before the higher court. "The Resolution that imposes the sanctions indicated in this publication is only final in administrative proceedings, without prejudice to the jurisdictional review powers that correspond to the Contentious-Administrative Chamber of the National Court", clarifies the provision published this Friday in the BOE, opens the door to an appeal of the penalties before the National Court.
Vidrala was founded in 1965 with headquarters in Llodio (Álava) and manufactures and sells glass containers for the food industry. In 1967 it began to export. It is one of the most powerful glass manufacturers in Western Europe. The company has been listed since 1985 on the Bilbao Stock Exchange and Madrid Stock Exchange. In 2007 they acquired the Belgian Verre, after the acquisition of Verlipack's production facilities. In 2015, it became the fourth European operator offering a complete service, in addition to the manufacture of glass containers, now also including decoration, packaging processes and logistics services. The group merged in 2017 with Santos Barosa, manufacturer of glass containers in the town of Marinha Grande, Portugal, from where it produces more than 1,600 million containers per year.

La entidad de servicios financieros Norbolsa tendrá que pagar 40.000 euros por no informar de las irregularidades del fabricante de vidrio ante el regulador.
La Comisión Nacional del Mercado de Valores (CNMV) ha multado a la empresa vasca de fabricación y venta de envases de vidrio Vidrala con 150.000 euros y a su director financiero, Raúl Gómez Merino, con otros 30.000 euros por la realización de prácticas de manipulación en el mercado en el periodo comprendido entre el 1 de septiembre y el 19 de octubre de 2015. Además, el regulador bursátil ha impuesto una sanción de 40.000 euros a Norbolsa, entidad de servicios financieros, por incumpliar su obligación de comunicar a este organismo las operaciones sospechosas de irregularidades realizadas por la compañía radicada en la provincia de Álava. Estas penalizaciones han sido publicadas este viernes en el Boletín Oficial del Estado (BOE).
La CNMV considera que Vidrala, su director financiero y Norbolsa cometieron una infracción grave tipificada en la Ley del Mercado de Valores. Las multas impuestas por el regulador han sido declaradas firmes en vía administrativa pero aún hay posibilidad de apelar ante la instancia de justicia superior. "La Resolución que impone las sanciones indicadas en la presente publicación únicamente es firme en vía administrativa, sin perjuicio de las potestades de revisión jurisdiccional que corresponden a la Sala de lo Contencioso-Administrativo de la Audiencia Nacional", aclara la disposición publicada este viernes en el BOE, lo abre la puerta a un recurso de las penalizaciones ante la Audiencia Nacional.
Vidrala es una empresa fundada en 1965 con sede en Llodio (Álava) que fabrica y vende envases de vidrio para la industria alimentaria. En 1967 comenzó a exportar. Es uno de los fabricantes de vidrio más potentes de Europa Occidental. La compañía cotiza desde 1985 en la Bolsa de Bilbao y la de Madrid. En 2007 adquierió la vidriera belga Verre fundada en junio del año 2000 tras la adquisiín de las instalaciones productivas de Verlipack.
En el 2015 se convierte en el cuarto operador europeo ofreciendo un servicio completo incluyendo además de la fabricación de envases de vidrio, procesos de envasado y servicios logísticos. El grupo se hizo en 2017 con Santos Barosa, fabricante de envases de vidrio que opera un gran centro de producción ubicado en la localidad de Marinha Grande, Portugal, desde donde produce más de 1.600 millones de envases al año. Vidrala cuenta actualmente con nueve plantas en cinco países: España, Portugal, Italia, Bélgica, Inglaterra e Irlanda del Norte.
